Welcome to Peel Fitness! PEEL FITNESS S.L. (“Peel,” “we,” “us,” and “our”) provides a personalized online fitness coaching and workout program, fitness community, and related services, content, features, and products through the Peel Fitness website (the “Peel Fitness Site” or the “Site”) and through mobile and desktop applications. By registering as a member or by visiting, browsing, or using the Peel Fitness platform in any way, you (as a “user” or as a "coach") accept these Terms of Service (“Terms”), which form a binding agreement between you and Peel Fitness. 1. Eligibility

1.1 User Eligibility

To use Peel Fitness, users must be at least 18 years of age. By using this Site, you represent and warrant that you are of legal age to form a binding contract with us and meet all the eligibility requirements. If you do not meet all these requirements, you must not access or use the Site.

 

1.2 Coach Eligibility

To become a Coach on Peel Fitness, you must meet the eligibility criteria outlined in our Coach Guidelines, which include but are not limited to professional certifications, experience, and adherence to fitness industry standards. Peel Fitness reserves the right to review and approve Coach applications at its discretion. As part of the onboarding process, Peel Fitness may require Coaches to undergo a verification process to ensure the accuracy of the provided information.

 

1.3 Compliance with Laws

Users and Coaches must comply with all applicable local, state, and national laws while using the Peel Fitness platform.

 

2. Account Creation

2.1 User Account Creation

To access certain features of the Peel Fitness platform, users must create an account by providing accurate and complete information.

 

2.2 Coach Account Creation

To use the platform as a Coach, you must create a Peel Fitness account. The account creation process involves providing accurate and comprehensive information about your fitness expertise, certifications, and professional background. Coaches agree to maintain accurate and up-to-date information on their Peel Fitness accounts, including personal details, certifications, and professional qualifications.

 

2.3 Account Security

Users are responsible for maintaining the confidentiality of their account information, including their password, and for all activities that occur under their account. Users agree to notify Peel Fitness immediately of any unauthorized use of their account.

 

3. Services Offered

3.1 Scope of Services

Coaches may offer a variety of fitness coaching services, including but not limited to personalized training programs, nutrition advice, live coaching sessions, and progress tracking. Users can subscribe to these services through personal training subscriptions.

 

3.2 Client Communication

Coaches must maintain open and effective communication with clients subscribed to personal training services, including regular updates, responding to queries in a timely manner, and providing necessary support from the in-app messaging service.

 

3.3 No Guarantee of Results

Peel Fitness does not guarantee any specific results from using the services provided by the coaches.

 

3.4 Responsibility of Advice

Peel Fitness is not responsible for any advice or recommendations provided by the coaches.

 

4. Subscriptions and Fees

4.1 User Subscriptions

Users can subscribe to personal training services provided by Coaches. Subscription details, including pricing and duration, are available on the Peel Fitness platform.

 

4.2 Coach Subscriptions

Coaches must subscribe to use the digital goods on Peel, such as workout plans and diet plans, according to the packages offered by Peel

Fitness.

 

4.3 Fee Structure

Coaches should incorporate Peel Fitness's platform fee of 30% into the total fees offered for each coaching service. This fee is calculated based on the total amount earned from services provided through the Peel Fitness platform.

 

4.4 Transaction Fees

Coaches are responsible for any transaction fees associated with receiving payments through the Peel Fitness platform. Transaction fees may apply, and detailed information is available in the Payment Terms.

 

4.5 Payment Schedule

Coach payments are processed according to the payment schedule outlined in the Payment Terms and Coach Guidelines.

 

4.6 Receiving Payments

4.7 Changes in Fees

Peel Fitness reserves the right to change the subscription fees at any time. Users will be notified of any fee changes with a notice period.

 

4.8 Automatic Renewals

Subscription renewals will be automatic unless canceled by the user and/or coach before the end of the current subscription period.

 

5. External Payments

5.1 Payment Transactions

Coaches agree not to offer or accept payments outside the Peel Fitness platform for services provided through the platform. This policy ensures transparency, security, and fair compensation for services rendered.

 

6. User Conduct

6.1 Basics

Requesting or providing personal contact details to communicate outside of Peel Fitness to circumvent or abuse the Peel Fitness messaging system or platform is not permitted. Any necessary exchange of personal information required to continue a service may be exchanged within the Peel Fitness platform.

 

6.2 Dispute Resolution

Peel Fitness provides dispute resolution support upon request. Coaches and users should contact Peel Fitness support to address any service-related issues.

 

6.3 User Protection

Peel Fitness does not provide protection for users who interact outside of the Peel Fitness platform. All information and file exchanges must be performed exclusively on Peel Fitness's platform.

 

6.4 Communication Standards

Rude, abusive, improper language, or violent messages will not be tolerated and may result in an account warning or the suspension/removal of your account.

 

6.5 Non-Discrimination

Peel Fitness is open to everyone. Coaches must not discriminate against any other user based on gender, race, age, religious affiliation, sexual orientation, or otherwise. Discrimination may result in the suspension/removal of your account.

 

6.6 Off-Platform Engagement

Users may not submit proposals or solicit parties introduced through Peel Fitness to contract, engage with, or pay outside of Peel Fitness.

 

6.7 Warning System

Peel Fitness employs a warning system for violations of these Terms or Peel Fitness policies. Warnings may be sent via email and displayed on the platform. Warnings may affect account statuses and, in severe cases, result in permanent disablement.

 

6.8 Non-Permitted Usage

Coaches must not engage in non-permitted usage, including but not limited to the exchange of adult services, inappropriate behavior, phishing, spam, privacy breaches, and fraudulent activities.

 

6.9 Multiple Accounts

Coaches are limited to one active Peel Fitness account. Creating additional accounts to circumvent guidelines may result in account disablement.

 

6.10 Prohibition of Illegal Activities

Users and coaches must not use the platform for any illegal activities or purposes.

 

7. Data Privacy and Security

Peel Fitness is committed to protecting your privacy. For detailed information on how we collect, use, and share your personal data, please refer to our Privacy Policy.

 

8. Confidentiality

8.1 User Information

Coaches agree to maintain the confidentiality of user information obtained through the Peel Fitness platform. This includes but is not limited to personal details, health information, and any other sensitive data. Coaches must not disclose or use such information for any purpose other than providing coaching services through Peel Fitness.

 

8.2 Compliance with Privacy Laws

Coaches must comply with all applicable privacy and data protection laws when handling user information.

 

9. Feedback Rights

9.1 Feedback Collection

Peel Fitness may collect feedback from users regarding Coach services. Coaches acknowledge and agree that such feedback may be publicly displayed on the Peel Fitness platform.

 

9.2 Use of Feedback

Peel Fitness reserves the right to use, publish, or modify feedback for marketing, promotional, or improvement purposes. To the extent that you provide Peel Fitness with any comments, suggestions, or other feedback regarding the Peel Fitness platform or the Site as a whole, as well as other Peel Fitness products or services (collectively, the “Feedback”), you will be deemed to have granted Peel Fitness an exclusive, royalty-free, fully paid up, perpetual, irrevocable, worldwide ownership rights in the Feedback. Peel Fitness is under no obligation to implement any Feedback it may receive from users.

 

10. Disclaimer and Limitation of Liability

10.1 Disclaimer

Peel Fitness makes no warranties, express or implied, regarding the accuracy, reliability, or completeness of any information provided by Coaches. Coaches are solely responsible for the content and quality of the services they provide.

 

10.2 Limitation of Liability

To the extent permitted by applicable law, Peel Fitness shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use Peel Fitness, (b) any unauthorized access to or use of our servers and/or any personal information stored therein, (c) any interruption or cessation of transmission to or from the platform, (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our platform by any third party, (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through Peel Fitness, and/or (f) user content or the defamatory, offensive, or illegal conduct of any third party. In no event shall Peel Fitness's aggregate liability for all claims related to the platform exceed twenty euros (€20) or the total amount of fees earned by the Coach through Peel Fitness in the last six months, whichever is greater.

 

11. End User License Agreement (EULA)

12. Governing Law and Jurisdiction

12.1 Governing Law

These Terms are governed by the laws of Spain. Users agree that any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Barcelona.

 

12.2 Jurisdiction

Any legal action arising from these Terms shall be brought before the courts of Barcelona.

 

13. Refund Policy

13.1 User Refunds

Refunds for user subscriptions are available under the following conditions:

- Within 7 days of purchase if no significant use of services has occurred.

- If services are not provided as described.

 

13.2 Requesting a Refund

Refund requests can be submitted to support@peelfitness.com and will be processed within 14 business days.

 

13.3 Pro-Rata Refunds

Pro-rata refunds may be provided for partial use of services, at the discretion of Peel Fitness.

 

14. Entire Agreement

Our Privacy Policy and Payment Terms form a part of this Agreement. Please review the Privacy Policy to learn about our collection and use of personal information. This Agreement also incorporates Payment Terms and any other policies or procedures referenced herein that are posted to the PEEL FITNESS Site from time to time. In the event of a conflict between any policies posted on the PEEL FITNESS Service and the terms of this Agreement, the terms of this Agreement will control. This Agreement represents the entire understanding between PEEL FITNESS and you and supersedes all prior agreements and understandings regarding the same.
